1. Scope and Acceptance
This Website Legal Notice and General Risk Disclosure applies to atlastrade.ai, app.atlastrade.ai, Atlas Trade AI software, related applications, customer portals, educational materials, demonstrations, communications, and other services made available by Atlas Trade AI LLC ("Atlas," "we," "us," or "our"). It supplements, and is incorporated into where applicable, the Terms of Service and Customer Agreement, End User License Agreement, applicable product and risk disclosures, Privacy Policy, Cookie and Tracking Technologies Notice, Billing, Subscription and Automatic-Renewal Policy, and Dispute, Cancellation and Refund Policy.
By accessing or using the website or platform, you acknowledge that trading involves substantial risk and that technology can fail. If you activate automated trading, you further acknowledge that orders may be generated, transmitted, modified, or canceled through your connected brokerage account without contemporaneous per-trade confirmation from you.
2. What Atlas Is
Atlas provides self-directed automated trading software and related technology that can connect to supported third-party brokerage accounts. The Services can allow users to select, configure, activate, monitor, pause, and deactivate automated trading strategies and related tools. Depending on the enabled feature, the software may analyze market or other data and may automatically generate, transmit, modify, or cancel orders in accordance with activated strategy logic, user-selected settings, broker controls, market conditions, and system availability.
Atlas-created pre-seeded strategies are rule-based and are designed to present human-readable entry and exit logic and available risk parameters before activation. Users may also create or configure strategies through Oculus where included in their plan and supported by the relevant product and brokerage connection.
Atlas does not hold customer brokerage cash or securities and is not the custodian of customer assets. Customer brokerage accounts are opened, carried, custodied, cleared, and serviced by independent third-party brokerages under separate agreements between the customer and the brokerage. Atlas does not obtain authority to withdraw or transfer customer brokerage assets. You are responsible for reviewing the permissions granted through each brokerage connection.
3. Self-Directed User Decisions and Automated Mechanics
You are responsible for deciding whether to trade, whether to use Atlas, which supported brokerage account to connect, which available strategy or configuration to activate, the amount of capital you maintain at your brokerage, which available risk controls or settings to use, and whether to enable margin trading where that control is available. Available controls may include position limits, risk per trade, position-size limits, stop-loss settings, take-profit settings, trailing-stop settings, daily and overall drawdown controls, daily profit targets, exposure limits, and strategy allocations.
Atlas does not know your complete financial circumstances, tax position, liquidity needs, investment objectives, or ability to bear losses unless a specific feature expressly requests information for a stated purpose.
Once you activate automation, the software may act without asking you to approve each individual order. "Self-directed" refers to your decision to select and activate the technology, strategy, and settings; it does not mean that every automated order requires a separate click or approval. You retain the ability to pause or disconnect automation, close individual trades, and place manual trades, subject to brokerage, market, order-status, and system limitations.
BROKERAGE ACCOUNT CONNECTION AND EXISTING POSITIONS. You should connect only a brokerage account that has no open positions you wish to keep. As part of completing a supported brokerage connection, the Atlas connection process is designed to transmit orders to close all existing open positions in that account so the account can begin from the position state required by the platform. Those liquidation orders can realize gains or losses, create tax consequences, incur brokerage or market costs, and execute at prices different from the prices displayed when you connect. Orders may also be rejected, delayed, or only partially filled. Review the brokerage account before connecting, close or transfer any position you wish to retain before proceeding, and independently verify the resulting orders and positions at the brokerage.
4. Regulatory Status and No Individualized Professional Advice
Atlas is not a bank, clearing agency, exchange, or custodian. Atlas is not registered with the U.S. Securities and Exchange Commission as a broker-dealer or investment adviser and is not currently registered with the U.S. Commodity Futures Trading Commission as a commodity trading advisor. This statement describes Atlas's current registration status and is not a representation that a particular activity is categorically outside any federal or state regulatory definition.
Unless Atlas expressly enters into a separate written agreement stating otherwise, Atlas does not undertake to provide personalized financial planning, tax, legal, accounting, or fiduciary services. Information about software, strategies, markets, risk controls, historical data, and product functionality is provided to explain the platform and support users' own decisions. Atlas personnel and product interfaces are not authorized to determine which strategy, security, brokerage, account type, allocation, or risk setting is appropriate for your personal circumstances. Nothing on the website or in the Services is a guarantee that a strategy, security, market, or course of action is suitable for you.
5. Substantial Risk of Trading Loss
Trading stocks, exchange-traded products, options, and other securities can result in rapid and substantial losses. Prices can gap, liquidity can disappear, markets can halt, orders can be rejected or filled at different prices than expected, and protective orders may not execute at their specified prices. You can lose some or all of the capital committed to trading.
Where margin, leverage, short positions, options, or other leveraged products are used, risk can be materially greater. Depending on the account and product, losses may exceed the amount initially deposited or committed, brokers may issue margin calls, and brokers may liquidate positions without advance notice. You are responsible for understanding and complying with your brokerage's account, margin, options, settlement, and trading rules.
6. Automation and Technology Risk
Automated trading introduces risks that do not exist in manual trading. Examples include connectivity failures, delayed or stale data, software defects, configuration errors, duplicate or missing instructions, API changes, authentication failures, rate limits, brokerage outages, exchange halts, rejected orders, partial fills, unexpected position states, clock or synchronization issues, model errors, and discrepancies between Atlas records and the brokerage's official records.
No stop loss, daily loss limit, take-profit setting, allocation cap, monitoring system, AI process, or other control can guarantee that losses will be prevented or limited to a predetermined amount. You should monitor your brokerage account independently and maintain the ability to intervene directly through the brokerage.
7. Third-Party Brokerage and Data Services
Atlas depends on independent brokerages, exchanges, market-data providers, cloud providers, payment processors, and other third parties. Atlas does not control their availability, execution quality, margin decisions, maintenance schedules, account approvals, data accuracy, order-routing decisions, or security practices. A brokerage may reject, delay, modify, cancel, or liquidate orders or positions under its own rules and agreements.
Your brokerage's confirmations, statements, and records are the authoritative records of transactions in your brokerage account. If an Atlas display differs from the brokerage, rely on the brokerage record to manage risk and contact Atlas regarding the discrepancy.
8. Performance, Backtesting, and Historical Information
Past performance is not indicative of future results. Any backtested, simulated, hypothetical, model-generated, or paper-trading result does not represent actual trading unless it is expressly labeled as an actual verified result. Simulated results can benefit from hindsight and assumptions and may not fully reflect slippage, liquidity, commissions, fees, market impact, taxes, rejected orders, outages, position limits, borrowing constraints, changing market regimes, or the psychological and financial consequences of actual losses.
No representation is made that any account will achieve results similar to any example, backtest, model, illustration, testimonial, or prior period.
9. AI and Model Risk
Certain current or future Atlas features may use artificial intelligence, machine learning, statistical models, optimization techniques, natural-language interfaces, or agentic systems. AI-assisted output can be inaccurate, incomplete, delayed, non-deterministic, or inconsistent with later data. AI terminology describes technology and does not imply that a feature is autonomous, self-learning, error-free, predictive of future returns, or superior to non-AI methods unless Atlas expressly substantiates that claim.
Current Atlas-created pre-seeded securities strategies are rule-based rather than strategies whose trading logic is generated continuously by a machine-learning model. Any future agentic feature with expanded authority will be subject to a feature-specific authority disclosure and separate acknowledgment before activation.
10. Options and Futures Status
As of the Effective Date, Atlas's generally available automation is focused on supported U.S. equities functionality. Options functionality may be offered only when enabled by Atlas and only to users who satisfy applicable brokerage approval, account, data, and platform requirements. Before trading standardized options, users must review the current OCC Characteristics and Risks of Standardized Options and the Atlas Options Risk Disclosure.
Futures and other commodity-interest functionality are not currently offered. Any reference to planned futures functionality is a roadmap statement, not an offer, entitlement, or representation of current availability. Atlas will not make futures functionality generally available until required legal, regulatory, registration or exemption, disclosure, and brokerage or FCM arrangements are in place.
11. No Guarantee or Warranty of Trading Outcomes
Atlas does not guarantee profit, minimum returns, benchmark outperformance, loss avoidance, uptime, uninterrupted brokerage connectivity, a particular fill, or that an automated strategy will continue to behave as it did in historical data. Trading decisions and use of the platform are at the user's risk, subject to non-waivable rights and remedies provided by applicable law.
