Privacy Policy & U.S. State Privacy Notice

How Atlas Trade AI collects, uses, discloses, retains, and protects personal information and handles privacy rights.

1. Scope

This Privacy Policy explains how Atlas Trade AI LLC collects, uses, discloses, retains, and protects personal information when you use atlastrade.ais, applications, communications, customer support, billing flows, and brokerage-connected Services. It does not govern information handled independently by your brokerage, payment processor, or another third party under that party's own privacy notice.

For this Policy, "personal information" means information that identifies, relates to, describes, can reasonably be associated with, or can reasonably be linked to an individual or household, subject to applicable-law definitions and exclusions.

2. Information You Provide

Depending on how you interact with Atlas, we may collect:

  • Account and contact information, such as name, email address, telephone number, mailing address, username, and account preferences.
  • Identity, eligibility, and account information you submit, including age confirmation and information needed to administer account access.
  • Purchase, order, invoice, subscription, and payment metadata. Full payment-card details are handled by our payment processor and are not intended to be stored on Atlas systems.
  • Support requests, communications, survey responses, feedback, call or meeting information where notice and consent are provided, and records of legal or privacy requests.
  • Strategy prompts, configurations, selections, risk settings, and other information you submit through Atlas, Oculus, Veridian, AI-assisted, or product interfaces.
  • Marketing preferences and consent records, including email, telephone, or text-message preferences where applicable.

3. Information From Connected Brokerages

When you authorize a supported brokerage connection, Atlas may receive information permitted by the connection and needed for enabled Services. Depending on the brokerage and permission scope, this can include account identifiers, account type and status, balances, buying power, positions, orders, fills, transactions, performance-related data, margin information, and related brokerage data.

Atlas uses brokerage data to provide enabled Services, generate and transmit authorized order instructions, display and reconcile account states, maintain security, provide support, troubleshoot, and comply with legal obligations. Atlas does not use brokerage data to train generalized AI models unless Atlas provides separate notice and has a lawful basis, including consent where required.

Atlas does not receive authority to withdraw or transfer customer brokerage assets. A brokerage's own collection, use, retention, and disclosure of information is governed by its privacy notice and agreements.

4. Information Collected Automatically

We may collect device, browser, operating-system, IP address, approximate location derived from IP, session, log, cookie, advertising or analytics identifier, page and event, referral source, security, diagnostic, and performance information when you use atlastrade.ais or applications.

The Cookie and Tracking Technologies Notice describes categories of cookies and similar technologies and available controls.

5. Sources of Personal Information

We collect information directly from you; from your device or browser; from brokerages and integrations you authorize; from service providers supporting payment, communications, analytics, security, support, identity, or hosting; from business partners where permitted; and from public or commercially available sources where appropriate and lawful.

6. How Atlas Uses Personal Information

Atlas may use personal information to:

  • Provide, administer, personalize, maintain, and secure the Services.
  • Authenticate users and establish and maintain brokerage integrations.
  • Process authorized order instructions and reconcile account states.
  • Display account, position, order, strategy, and performance information.
  • Administer purchases, subscriptions, billing, cancellations, and refunds.
  • Provide customer support, service notices, and requested communications.
  • Detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity.
  • Troubleshoot, measure reliability and product use, improve existing features, and develop new features.
  • Maintain records, enforce agreements, exercise or defend legal claims, and comply with law and valid legal process.
  • Send marketing communications as permitted by law and consistent with your preferences.

Where required, Atlas obtains separate consent for text messages, automated calls, sensitive information, or other regulated communications. Consent to marketing is not a condition of purchasing the Services unless expressly permitted by law.

7. AI and Model Use of Customer Information

If Atlas uses prompts, account information, strategy configurations, support content, or other personal information to operate an AI feature, Atlas uses that information to provide the requested feature, maintain security and reliability, support the user, and improve the feature as described at collection or in the applicable interface.

Atlas may use service providers to host or operate AI functionality. Atlas applies contractual, access, retention, and security controls appropriate to the information and feature. Where appropriate, Atlas may minimize, redact, or pseudonymize information. Atlas will provide additional notice or consent before using personal information for a materially different purpose where required by law.

8. How Personal Information Is Disclosed

Atlas may disclose personal information:

  • To service providers and contractors supporting hosting, security, analytics, communications, customer support, payment processing, identity services, brokerage connectivity, market data, AI features, and other business functions.
  • To brokerages, exchanges, data providers, or counterparties as necessary to establish and provide a requested connection or functionality.
  • To professional advisers, auditors, insurers, and financing sources under appropriate obligations.
  • In connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar corporate transaction.
  • To authorities or other parties when reasonably necessary to comply with law or valid legal process, protect rights and safety, investigate fraud or abuse, or enforce agreements.
  • At your direction, with your consent, or as otherwise disclosed when the information is collected.

Atlas does not disclose text-message opt-in data or consent to third parties for their independent marketing where prohibited by law or applicable messaging rules.

9. Sale, Sharing, and Targeted Advertising

Atlas does not sell personal information for money. Depending on the analytics or advertising technologies used on atlastrade.ais, certain disclosures may be treated as "sale," "sharing," or targeted advertising under some state privacy laws even when no money changes hands. Where those laws apply, Atlas provides required opt-out mechanisms through the Privacy Choices or Cookie Settings interface and honors legally required opt-out preference signals as described below.

Atlas does not knowingly sell or share the personal information of individuals under 18.

10. Cookies and Tracking Technologies

Atlas may use strictly necessary cookies and, subject to applicable consent and opt-out requirements, analytics, preference, functionality, and advertising technologies. Use the Privacy Choices or Cookie Settings link in the website footer to review available controls. Disabling a technology can affect site or application functionality.

Where legally required, Atlas recognizes a valid browser-based opt-out preference signal, including Global Privacy Control, as a request to opt out for the applicable browser or device and, where required and technically feasible, associates the choice with an authenticated account.

11. Retention

Atlas retains personal information for as long as reasonably necessary for the purposes described in this Policy, including account operation, security, dispute resolution, fraud prevention, legal obligations, and records. Retention periods vary by data category, relationship, legal requirement, and operational need. Information may remain in protected backups for a limited lifecycle after active deletion.

12. Security

Atlas uses administrative, technical, and organizational safeguards designed to protect personal information. No system is perfectly secure, and Atlas cannot guarantee that unauthorized access, loss, or interruption will never occur. The Security Overview provides additional information without disclosing sensitive security details.

13. U.S. State Privacy Rights

Depending on your state, Atlas's activities, and applicable legal thresholds, you may have rights to:

  • Confirm whether Atlas processes your personal information and access that information.
  • Correct inaccurate personal information.
  • Delete certain personal information.
  • Obtain a portable copy of certain personal information.
  • Obtain information about categories of personal information, sources, purposes, and recipients.
  • Opt out of certain sales, sharing, targeted advertising, or profiling with legal or similarly significant effects.
  • Limit certain uses or disclosures of sensitive personal information where applicable.
  • Appeal a denial of a privacy request.

Atlas will not discriminate against you for exercising a privacy right as prohibited by law. Atlas may need to verify your identity and authority before fulfilling a request. Authorized agents may submit requests where permitted, subject to verification. Atlas may deny or limit a request where an exception applies and will explain appeal options when required.

14. Sensitive Personal Information

If Atlas collects information classified as sensitive under applicable law, Atlas limits its use to disclosed and permitted purposes and provides any required limitation or consent mechanism. Avoid submitting government identifiers, precise geolocation, biometric data, brokerage passwords, one-time codes, or full payment-card numbers unless a specific authorized flow requires the information.

15. Children

The Services are not directed to children and are intended for persons aged 18 or older who are legally capable of controlling an eligible brokerage account. Atlas does not knowingly solicit personal information from children through the trading platform. If Atlas learns it collected information from a child contrary to this Policy, it will take appropriate steps consistent with law.

16. International Users and Data Processing

Atlas is designed primarily for jurisdictions and brokerage relationships Atlas expressly supports. If you access the Services from outside the United States, your information may be processed in the United States and other locations where Atlas or its service providers operate, which may have different data-protection laws. You are responsible for using the Services only where permitted. Atlas will provide any additional notices, transfer mechanisms, or rights required for a jurisdiction it actively supports.

17. Changes to This Policy

Atlas may update this Policy as practices or law change. Material changes will be communicated as required by law. The "Last Updated" date identifies the current version. A materially different use of previously collected personal information will be subject to additional notice or consent where required.

Self-Directed Automated Trading Software Disclosure: Atlas Trade AI LLC provides self-directed automated trading software and related technology. Users independently select their brokerage account, strategy, available settings, and whether to activate, pause, change, or disconnect automation. Atlas does not determine which strategy, security, brokerage, account type, allocation, or risk setting is appropriate for a user's personal circumstances.

Once activated, Atlas software may automatically generate and transmit order instructions under the strategy and settings selected by the user without per-trade confirmation. The connected brokerage is responsible for accepting, routing, and executing orders and for custody, clearing, margin, and official account records. Atlas does not hold customer brokerage assets and cannot withdraw or transfer them.

Existing positions: Connect only an account with no open positions you wish to keep. Completing a supported brokerage connection is designed to transmit orders to close all existing open positions. Closing positions can realize gains or losses, create tax consequences, and incur fees, spreads, slippage, or other costs. Orders can be rejected, delayed, or partially filled. Review the brokerage account before and immediately after connecting.

Risk disclosure: Trading securities and automated trading involve substantial risk of loss. Market gaps, volatility, liquidity, rejected or partial orders, slippage, outages, brokerage delays, and other events can cause losses. Stop losses, drawdown limits, take-profit controls, allocations, and other controls are not guarantees. No profit, return, outperformance, or protection from loss is guaranteed. Past performance is not indicative of future results. Backtested, hypothetical, simulated, paper, or model-generated results are not actual trading and have material limitations.
